Welcome to Forkly AI. These Terms of Service ("Terms") govern your use of our mobile application and services. By using Forkly AI, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Forkly AI, you agree to be bound by these Terms and our Privacy Policy. If you don't agree to these Terms, please don't use our services.

2. Description of Service

Forkly AI is an AI-powered food tracking application that helps users:

• Track calories and nutrition through photo recognition
• Monitor health and fitness goals
• Access nutritional information and insights
• Sync with Apple HealthKit

3. User Accounts

3.1 Account Creation

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 13 years old to create an account.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. Please notify us immediately of any unauthorized use.

3.3 Apple Sign In

We support Sign in with Apple for account creation and authentication. When using Apple Sign In, you are also subject to Apple's terms and conditions.

4. Subscription and Payment

4.1 Premium Features

Some features require a premium subscription. Subscription terms and pricing are clearly displayed in the app.

4.2 Free Trial

We may offer a free trial period for premium features. You will not be charged during the free trial period. The subscription will automatically renew at the end of the trial unless cancelled before the trial ends.

4.3 Billing

Subscriptions are billed through the Apple App Store and processed by RevenueCat. All payments are subject to Apple's terms and conditions. Payment will be charged to your Apple ID account at confirmation of purchase.

4.4 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.5 Cancellation

You can manage and cancel your subscription at any time through your Apple ID Account Settings. Cancellation will take effect at the end of the current billing period.

4.6 Refunds

Refund requests are handled according to Apple's refund policy. We cannot directly issue refunds for purchases made through the App Store.

5. User Conduct

You agree not to:

• Use the service for any illegal purposes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Upload malicious content or code
• Violate any applicable laws or regulations

6. Health Disclaimer

Important: Forkly AI is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before making any health or dietary changes.

7. Intellectual Property

All content, features, and functionality of Forkly AI are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

8. User Content

8.1 Your Rights

You retain ownership of any content you submit to Forkly AI, including photos and personal data.

8.2 License to Us

By submitting content, you grant us a limited license to use, process, and display your content solely for providing and improving our services.

9. Privacy and Data Protection

Your use of Forkly AI is also governed by our Privacy Policy. We are committed to protecting your personal information and health data.

10. Third-Party Services

Our app may integrate with third-party services. We are not responsible for the practices or content of these third-party services.

11. Disclaimers

The service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the service or violation of these Terms.

14. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may also delete your account at any time through the app settings.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the app or via email. Continued use after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forkly AI regarding the use of our service.
